Lawyer Fined R$ 24k for Improper ChatGPT Use; Check It

In 2019, Steven A. Schwartz, in partnership with lawyer Peter LoDuca, represented a client against an airline for personal injury. After the airline requested dismissal due to the statute of limitations, the attorneys filed petitions citing previous cases to continue the trial.

The company found false information in the petition. The judge questioned the lawyers, revealing Steven A. Schwartz's misuse of ChatGPT, unknowingly providing inaccurate data due to his 30+ years of experience. Peter LoDuca, the other lawyer, was not involved in the research.

On June 8, the lawyers attended a hearing where they were fined $5,000 (approximately R$24,000) by the judge. The judge condemned their conduct, accusing them of bad faith in presenting false cases and demanded that they send letters of apology to the judges mentioned in the fraudulent document.

Schwartz's ChatGPT research had false information. With over 30 years of experience, he admitted misusing AI, unaware of its potential to provide incorrect data. Peter LoDuca, the other lawyer, was not involved in the research.

Be aware of limited updated data. Despite providing comprehensive information, the model is based on a database cut-off until 2021, leading to potentially outdated responses.
